1. Agreement to These Terms

These Terms of Use (“Terms”) govern your access to and use of luxoriarecovery.com and any subdomains (the “Site”), operated by Luxoria Recovery (“Luxoria Recovery,” “we,” “us,” or “our”).

 

By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.

 

2. Who May Use the Site

The Site is intended for adults 18 years of age or older who are located in the United States. By using the Site you represent that you meet these requirements.

 

3. The Site Is Not Medical Advice

The content on this Site, including all pages, blog articles, guides, videos, and frequently asked questions, is provided for general educational and informational purposes only. It is not medical advice, clinical advice, a diagnosis, a treatment recommendation, or a substitute for consultation with a qualified healthcare professional.

 

Substance use disorder and co-occurring conditions vary substantially between individuals. Nothing on this Site should be used to diagnose a condition, to determine an appropriate level of care, or to decide whether to start, stop, or change any medication or treatment. Withdrawal from alcohol and certain other substances can be medically dangerous and in some cases fatal. Do not attempt to stop using a substance on your own based on anything you read on this Site. Speak with a medical professional first.

 

4. No Provider-Patient Relationship

Using the Site, reading its content, submitting a form, or exchanging initial messages with our team does not create a provider-patient, physician-patient, or therapist-patient relationship between you and Luxoria Recovery or any of its clinicians.

 

A treatment relationship is established only after a clinical assessment, a written admission agreement, and the execution of the consents and authorizations required by law. The terms of any treatment relationship are governed by those documents and not by these Terms.

 

5. Medical Emergencies and Crisis Support

If you are experiencing a medical emergency, an overdose, or a mental health crisis, do not use this Site. Call 911 immediately.

 

If you are in emotional distress or thinking about suicide, call or text 988 to reach the Suicide and Crisis Lifeline, available 24 hours a day in the United States.

 

Luxoria Recovery does not provide emergency, crisis, or urgent care services, and does not monitor the Site or its forms for emergencies. We cannot respond to urgent requests submitted through the Site.

 

6. No Guarantee of Results

Recovery outcomes depend on many factors outside our control. Statements on the Site describing our clinical model, our program design, our team, or our facility are descriptions of what we offer. They are not promises, warranties, or guarantees of any particular outcome, including sobriety, symptom improvement, or the absence of relapse.

 

Where the Site includes statistics, research references, or third-party findings, those are provided for context. They describe populations, not individuals, and they do not predict your result.

 

7. Admission, Availability, and Pricing

Descriptions of our program, capacity, length of stay, amenities, therapies, and staffing on this Site are current as of the date of publication and are subject to change. Admission is subject to clinical eligibility, bed availability, and a completed admission agreement. Nothing on the Site is an offer to provide treatment or a binding quotation of price. Specific fees and payment terms are discussed directly and set out in your admission agreement.

 

8. Testimonials and Endorsements

Any testimonial, review, story, or endorsement appearing on the Site reflects the individual experience of one person. Individual experiences are not typical and are not indicative of what any other person will experience. We do not compensate individuals for testimonials unless that relationship is clearly disclosed alongside the testimonial.

You may view, download, and print pages from the Site for your own personal, non-commercial use, provided you do not remove any copyright or proprietary notice. Any other use, including reproduction, modification, distribution, republication, framing, or use of Site content to train or fine-tune a machine learning model, requires our prior written consent.

 

If you send us feedback, suggestions, or ideas about the Site, you grant us a perpetual, royalty-free, worldwide license to use them without obligation or compensation to you.

 

If you believe content on the Site infringes your copyright or other rights, notify us through our contact page with enough detail for us to identify the material and your claim, and we will review it.

To the fullest extent permitted by law, Luxoria Recovery and its owners, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of or inability to use the Site or any content on it, whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we were advised of the possibility of such damages.

 

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site will not exceed one hundred dollars ($100.00).

 

This Section 14 applies to your use of the Site only. It does not apply to, limit, or waive any claim arising out of the clinical care or treatment services Luxoria Recovery provides to a patient. Nothing in these Terms limits liability that cannot be limited under applicable law.

 

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

 

15. Indemnification

You agree to indemnify and hold harmless Luxoria Recovery and its owners, officers, employees, contractors, and agents from any claim, demand, loss, liability, or expense, including reasonable attorneys’ fees, arising out of your violation of these Terms, your misuse of the Site, or your submission of information you were not authorized to provide.

 

16. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Polk County, Florida, and you consent to the personal jurisdiction of those courts.

 

This section governs disputes about the Site. It does not govern disputes about clinical care, which are addressed in the admission agreement and by applicable Florida law.

 

17. Accessibility

We are working to make the Site accessible to as many people as possible, including users of assistive technology. If you encounter a barrier to accessing any part of the Site, let us know through our contact page and we will work to provide the information you need in an accessible form.

 

18. General Provisions

Changes. We may modify these Terms at any time by posting a revised version with an updated “Last Updated” date. Your continued use of the Site after a change means you accept the revised Terms.

 

Severability. If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full effect.

 

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

 

Entire agreement. These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the Site, and supersede any prior understandings on that subject. They do not supersede any admission agreement, consent, authorization, or other treatment document.

 

Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
